Mario's Pizza LLC (“we,” “us,” or “our”) operates mariospizzaak.com and the associated ordering, phone, and SMS services. This Privacy Policy explains what information we collect, how we use it, and the choices you have.

Information We Collect

Order & contact information: your name, phone number, delivery address (for delivery orders), and order details.
Payment information: processed directly by our payment provider, Clover. We do not store card numbers on our servers.
Call recordings & transcripts: when you call our AI phone receptionist or speak with staff, the call may be recorded and transcribed to place your order accurately.
Website usage data: standard log data (IP address, browser, pages visited) and, if enabled, aggregate analytics from tools like Google Analytics.

How We Use Your Information

To take, prepare, and deliver your orders.
To send order confirmations, pickup notifications, and secure payment links by SMS.
To respond to questions, resolve issues, and improve our service.
To comply with legal obligations (tax, fraud prevention, lawful requests).

How We Share Your Information

We do not sell or rent your personal information. We share it only with service providers who help us run the business — our payment processor (Clover), our SMS provider (Twilio), our AI phone provider (Bland AI), and our hosting provider (Vercel) — and only to the extent needed to provide the service you requested. We may also disclose information if required by law.

Data Retention

Order records are retained for up to 7 years for tax and accounting purposes. Call recordings and transcripts are retained for up to 90 days and then deleted unless needed to resolve a dispute.

Your Choices

SMS: reply STOP to any text to opt out. Reply HELP for assistance.
Access & deletion: contact us at the phone or email below to request access to or deletion of your personal information.

Children

Our service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

SMS Messaging Terms & Proof of Consent

Mario's Pizza sends transactional SMS messages (order confirmations and payment links) through our messaging provider, Twilio. This section documents our SMS program and customer opt-in process for regulatory and carrier verification purposes.

How Customers Opt In (Proof of Consent)

Customers opt in to receive SMS messages from Mario's Pizza in one of the following ways:

Verbal opt-in during a phone call.When a customer calls Mario's Pizza at (907) 852-1333, (907) 852-1332, or our AI receptionist line to place an order, our AI phone receptionist or a staff member reads the following script before finalizing the order:“To finish your order, I'll text a secure payment link and an order confirmation to this number, [phone number read back]. Message and data rates may apply. Reply STOP to opt out at any time. Is it okay to text you at this number?” The order is only finalized and the SMS is only sent after the customer gives an explicit verbal “yes” (or equivalent affirmative). The verbal consent is captured in the call recording and transcript, which are retained alongside the order record. If the customer declines, no SMS is sent and we offer alternative payment (in-person at pickup, or cash on delivery).
Online ordering. When placing an order through mariospizzaak.com/order, the customer provides their mobile number and, by submitting the order, agrees to receive transactional SMS messages related to that order.

Consent to receive SMS is not a condition of purchase for in-person orders. Customers can always choose to receive updates by phone call instead.

Message Types

Mario's Pizza sends only transactional SMS messages. We do not send marketing or promotional messages. Message types include:

Order confirmation after an order is placed.
Secure payment link for delivery orders.
Pickup-ready notification.
Reply to a customer-initiated HELP request.

Message Frequency

Typically 1–2 messages per order. We do not send recurring, scheduled, or marketing messages.

Opt-Out & Help

Reply STOP to any message to unsubscribe. You will receive a single confirmation message and no further texts.

Message and data rates may apply. Messages are sent via Twilio and supported by all major U.S. carriers.

Carriers & Liability

Carriers are not liable for delayed or undelivered messages. Mario's Pizza is the sender of record and participates in industry traceback efforts.

Terms of Service

By using our website, phone ordering line, or SMS service, you agree to these Terms of Service.

Orders & Payment

Prices shown on the menu and at checkout are in U.S. dollars and subject to change.
Delivery orders require prepayment through the secure payment link we send by SMS.
Pickup orders may be paid in-store or through a payment link at our discretion.
We reserve the right to refuse or cancel any order, for example if an item is unavailable or if an address is outside our delivery zone.

Delivery

Delivery is limited to the Barrow (Utqiagvik) area. Delivery fees and zones are disclosed at the time of order. Delivery times are estimates and may vary with weather and order volume.

Refunds

If your order is missing an item or prepared incorrectly, please call us at (907) 852-1333 as soon as possible and we will make it right — typically by replacing the item or issuing a refund to the original payment method.

Acceptable Use

You agree not to misuse our website, phone line, or SMS service, including by sending fraudulent orders, harassing staff, or attempting to disrupt our systems.

Intellectual Property

All content on this website (logos, images, menu copy) is the property of Mario's Pizza LLC and may not be reused without permission.

Disclaimers

Our service is provided “as is.” To the fullest extent permitted by law, Mario's Pizza LLC disclaims all warranties, express or implied. Our total liability for any claim related to an order is limited to the amount you paid for that order.

Governing Law

These terms are governed by the laws of the State of Alaska.
